Yeah that's what it means when it talks about licenses but I imagine a lawyer would put together a suit (probably even a class action suit) pretty quickly if it became a real thing since I can't imagine it wouldn't break privacy laws.

Jesus Christ you guys need to stop reacting to stuff that hasn't even been announced. Sony had patents granted not too long ago for some biometric scanner thing that would detect who was holding a controller. They apply for patents for weird shit like this all the time. If they come out and say "hey, this is why the Kinect is always on" then yes, we can all get appropriately annoyed and not buy an Xbox One, for now, please stop spazzing out over rumours and conjecture that these blogs are using to get angry mob page clicks.
